Summary of Changes to Myspace Terms of Use Agreement
We have revised the Terms of Use Agreement as of May 24, 2018. This summary summarizes the important changes. Please note that this summary is provided to help your review of changes to the Agreement. Please carefully review the entire Agreement prior to agreeing to be bound by it. We use certain capitalized terms in this summary. The definitions of these capitalized terms can be found in the Agreement.
- May 24, 2018
- We explained that after May 25, 2018 Myspace will no longer be offered to EEA residents under 16 years of age (Section 1)
- We clarified that Myspace may cease to offer the Services subject to its sole discretion and at any time. (Sections 2 and 3)
- We explained that Myspace currently only supports uploaded media flies that are in the MP4 format and clarified that users should back up any media files they upload since Myspace is not responsible for the continuing integrity, accessibility, or availability of uploaded content (Section 2)
- We added a reminder that Myspace may delete any profiles or content therein that have been inactive for greater than two years, but in its discretion may elect to retain them in the event you want to reactivate your account (Section 2)
- We clarified that certain content from Myspace classic is no longer available for retrieval or download and that media files and images that were uploaded more than three years ago are no longer available for playing, retrieval or download (Section 6.4)
- We provided further detail on the sharing of certain information about you with our Viant-affiliate companies and others, and clarified that we will no longer be sharing personal information pertaining to EEA residents for targeted, interest based advertising. (Sections 7.3 and 13.2)
- We updated our arbitration provision and class action waiver for U.S. users (Section 17.1)

- Introduction: We updated the Myspace® product description. We corrected the hyperlink in Myspace’s main URL. We added the reference to the Cookie Policy and the Video Privacy Policy and that you accept them by using the Myspace Services.
- Summary of Key Terms: We removed reference to classic Myspace. We added the reference to the Cookie Policy and the Video Privacy Policy and that you accept them by using the Myspace Services. We changed the reference to Specific Media to IMH-affiliated companies.
- Section 7.3: We added a reference to the Video Privacy Policy.
- Section 8.4: We added certain Prohibited Activities which relate to intellectual property and encryption.
- Section 10: We revised the hyperlinks to our copyright and trademark infringement forms and policies.
- Section 13.1: We added references to the Video Privacy Policy.
- Section 13.4: We added a statement that you agree to our interaction with and possible disclosure of information to law enforcement. We added a reference to our Law Enforcement Guidelines.
- Section 22: We added an End User License Agreement for any Software which we offer to Users and the terms governing your access to such Software.
- Section 23: We removed reference to where the Agreement is posted.

Summary of Changes to Myspace Privacy Policy
We have revised our Privacy Policy as of August 5, 2016. Please note that this summary is provided to help your review of changes to the Policy. - New privacy notice for residents of the European Economic Area. Our EEA Privacy Notice provides further information about rights that are specific to the EEA and makes it easier for EEA residents to locate the additional privacy terms that apply to them.
- Due to changes in the corporate structure of Myspace and its affiliates, we have provided new information about which companies hold and have access to your personal information. We have also clarified that, while our affiliates have their own privacy policies for information that they collect independently, they will treat your Myspace information in accordance with Myspace’s Privacy Policy.
- We have clarified that when we transfer your Myspace information to a third party, we require them to treat your information in accordance with the Myspace Privacy Policy. However, it continues to be the case that any information that you give directly to a third party (or that a third party website gathers from you in any way when you visit that website) is governed by the third party’s privacy policy.
- We have clarified that we may store information from inactive accounts (which are accounts not used for two years or more) in case you want to reactivate your account, but we are not obliged to do that.
- We have deleted references to separate privacy policies for our "classic" services because those versions of our services are no longer available.
- In line with evolving global privacy terminology, instead of distinguishing between "personal" and "demographic" information, we have revised our explanation of what aggregated data is and how we treat it, as compared to personal information.
- We have clarified what items of personal information cannot be hidden from public view when you use our services. We have provided additional information about how your privacy is protected when we (or our Affiliates) use your personal information for interest-based web advertising.

We revised information about the corporate ownership of Myspace.
We changed the reference to IMH-affiliated companies to Viant Technology, Inc.
We clarified that when you authorize us to share your information with third parties, those third parties may add information from other sources to that information, and they, in turn, may share your information with other third parties.
The goal of this revision is to make the Policy more user-friendly. We revised the Policy to make it less legalistic, more easily readable, and we reduced redundant disclosures. Please note that some of the section numbers have changed as a result of consolidation and simplification of disclosure. We removed references to the classic Myspace since we are rolling out the new Myspace platform in its place. References in the Policy to our sister company, Specific Media, have been expanded to include other IMH affiliates, including Specific Media, Vindico and Site Meter. We added certain disclosures related to recent legal developments. We reduced the use of defined terms and moved others to a “Key Terms” page in order to simplify the Policy and make the definitions of common terms easier to find. We revised certain disclosure about general and product specific privacy settings to reflect product updates. We clarified that we may share certain of your information with our service providers. We clarified that you may be served with advertising on the Myspace Services and on third party websites and platforms based on information about we collect or receive about you both on and off the Myspace Services. We also clarified that content recommendations may be based on information we collect or receive both on and off of the Myspace Services.
